Law 1: EXEQUATUR, French law. 1. This Latin word was, in the ancient practice, placed at the bottom of a judgment emanating from another tribunal, and was a permission and authority to the officer to execute it within the jurisdiction of the judge who put it below the judgment. 2. We have something of the same kind in our practice. When a warrant for the arrest of a criminal is issued by a justice of the peace of one county, and he flies into another, a justice of the latter county may endorse the warrant and then the ministerial officer may execute it in such county. This is called backing a warrant. (references)

Wikipedic Exequatur, the letter patent, issued by a Foreign Office and signed by a sovereign, which guarantees to a foreign-consul the rights and privileges of his office, and ensures his recognition in the state in which he is appointed to exercise them. If a consul is not appointed by commission, he receives no exequatur; and a notice in the Gazette in this case has to suffice. The exequatur may be withdrawn, but in practice, where a consul is obnoxious, an opportunity is afforded to his government to recall him. (references)

Extended Definition: EXEQUATUR

Exequatur

An exequatur is a patent which a head of state issues to a foreign consul which guarantees the consul's rights and privileges of the office and ensures recognition in the state to which the consul is appointed to exercise such powers. If a consul is not appointed by commission, the consul receives no exequatur; the government will usually provide some other means to recognize the consul. The exequatur may be withdrawn, but in practice, where a consul is obnoxious, an opportunity is afforded to his government to recall him.

It is also the name given to the permission from secular authorities which some dissident Roman Catholic churchmen believed was needed before Papal pronouncements could be enforced.[1]

In French law, an exequatur is a judgement by which a French tribunal states that a decision issued by a foreign tribunal should be executed in France.
